Terms of Use

These terms are the agreement between you and Yassine Zeriouh for the use of Arclift, an iPhone app. By downloading or using Arclift you accept them. If you do not accept them, please do not use the app.

Your licence

Arclift is licensed to you, not sold. You get a personal, non-exclusive, non-transferable licence to use the app on Apple devices that you own or control, as permitted by the App Store terms of service. Apple’s Licensed Application End User License Agreement applies in addition to these terms, and where the two conflict on a point it covers, Apple’s terms prevail.

You agree not to:

• copy, resell, rent or redistribute the app
• reverse engineer, decompile or attempt to derive the source code, except where law allows
• remove or obscure any notice of ownership
• use the app to break the law or to interfere with anyone else’s use of it

The app, its design, its text, its exercise library and its media are owned by Yassine Zeriouh or licensed to us, and are protected by copyright and other laws.

Health and fitness disclaimer

Arclift is a training log, not a medical device, and nothing in it is medical advice. Weight suggestions, rep targets, plateau and deload calls, recovery scores, readiness signals, estimated one-rep maxes and energy estimates are all calculations based on numbers you entered and, if you allow it, on data from Apple Health. They are estimates, and they can be wrong.

Resistance training carries a risk of injury. Talk to a doctor before starting or changing a training programme, particularly if you have a medical condition, are pregnant, are recovering from an injury, or are taking medication. Use good form, use appropriate equipment, use a spotter when it matters, and stop if something hurts. You are responsible for deciding what to lift. If you feel unwell while training, stop and seek medical attention.

Your data and your content

The workouts, templates, notes and photos you put into Arclift are yours. We claim no ownership of them. They are stored on your device and, when you are signed in to iCloud, in your own private iCloud database, which we cannot access. Keeping your own backups is a good idea, and we are not able to recover data for you. The Privacy Policy explains how information is handled.

Arclift Pro

Logging workouts, building templates, browsing the exercise library, keeping your history and exporting share cards are free. Arclift Pro is an optional paid upgrade that adds training statistics, per-exercise progress charts, the recovery and load body map, the progression coach and readiness-aware targets.

• Arclift Pro is offered as a monthly plan and an annual plan. The exact price, the length of the term and the price per month are shown on the purchase screen in the app, in your local currency, before you confirm anything. Prices can change over time, and a change never affects a term you have already paid for.
• Payment is charged to your Apple Account when you confirm the purchase. Apple handles the transaction; we never see your payment details.
• A subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. Your Apple Account is charged for renewal within the 24 hours before the period ends.
• Manage or cancel a subscription in the Settings app under your Apple Account, or from the Arclift settings screen. Deleting the app does not cancel a subscription.
• Where a free trial is offered, any unused part of it is forfeited if you buy a subscription during the trial.
• A lifetime purchase, where offered, does not renew. It unlocks Arclift Pro on your Apple Account permanently: as long as the app is on your device it keeps working, and if you reinstall it you can restore it. If we ever stop publishing Arclift, that does not switch off the copy you already have.
• Purchases can be restored on your other devices using the same Apple Account, through Restore Purchases in settings.

Apple, not us, is the seller for anything bought through the App Store, so the purchase contract is between you and Apple. Refunds therefore run through Apple under their policies, and you can request one at reportaproblem.apple.com. If you are a consumer in the EU, your 14-day right of withdrawal under sections 312g and 355 BGB applies to that contract and is exercised through Apple. Note that the right lapses for digital content once delivery has started with your express agreement, which is what you give when you confirm the purchase and Arclift Pro unlocks immediately.

Third-party services

Arclift relies on Apple for the App Store, iCloud, Apple Health and on-demand video delivery, on RevenueCat for subscription management and on TelemetryDeck for anonymous analytics. Their own terms and privacy policies apply to what they do. Outages or changes on their side can affect features such as syncing or restoring a purchase.

Changes to the app

We may add, change or remove features, and we may stop offering the app altogether. If a paid feature is discontinued during a term you have paid for, we will make a reasonable effort to provide an equivalent or a pro-rated remedy through Apple.

No warranty

Arclift is provided as is and as available, without warranties of any kind to the fullest extent the law allows. We do not warrant that it will be uninterrupted, error free, or that any calculation, suggestion or synced record will be accurate or preserved.

Limitation of liability

We are fully liable for damage caused intentionally or by gross negligence, for injury to life, body or health, and under the Produkthaftungsgesetz. We are also fully liable to the extent we have given a guarantee.

For ordinary negligence we are liable only where we breach a duty that is essential to performing this agreement and that you may reasonably rely on us to perform, and in that case only for the foreseeable damage typical of this kind of agreement. Any further liability for ordinary negligence is excluded.

Nothing in this section shifts responsibility for your training decisions. The suggestions Arclift makes are estimates, as set out under Health and fitness disclaimer above, and choosing what to lift remains yours.

Termination

You can stop using Arclift at any time by deleting it. We may suspend or end your licence if you materially breach these terms. The sections on health, ownership, warranties, liability and governing law survive the end of this agreement.

Apple

Apple is not a party to these terms and has no obligation to provide support or maintenance for Arclift. Apple is not responsible for any claim relating to the app, including product liability, a failure to meet a legal requirement, or a claim under consumer protection law. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the law of Germany. If you are a consumer, that choice cannot take away the protection of the mandatory consumer law of the country you live in, and it does not change where a case can be brought: you may sue us in the German courts or in the courts where you live, and we may only sue you where you live.

Changes to these terms

We may update these terms, for example to reflect a change in the app, in the law, or in the services Arclift relies on. If a change materially affects your rights, we will say so in the app or in the release notes at least 30 days before it takes effect, and we will say plainly what changed. If you do not want to accept it, you can stop using Arclift and cancel any subscription before the change takes effect. The date at the top of this page always reflects the current version.
